Yes they will do upgrades to subsequent owners. I did mine when I took it to stage 2 with no problem. I even told him it was flashed before I got my car.

APR charges $149 to transfer the warranty and do free upgrades. Sounds like your dealer cheated and put it down as the previous owner wanting an upgrade.
